I received a speeding ticket with no radar/patrol car #’s. Can it be beaten?
I received a speeding ticket and the officer never put his patrol car # or radar certification # on the citation. Can this be beaten? Also, this same citation was in a very rural part of town. Ticket was for 67 in a 50. I believe the speed was not unreasonable or unprudent for the conditions. Sunny afternoon. No traffic other than the officer & I. Any thoughts?
The laws vary from state to state, but in the 12 states I have lived in over the past 20 years I have never seen a state law that requires an officer to annotate a patrol car number or a radar certification number on a ticket.
The only way you can hope to beat this ticket is if you go to court and the officer who wrote you the ticket doesn’t show up. And your argument about your speed not being unreasonable or imprudent is bunk. No judge on the planet is going to care about what you think. All they care about is how fast you were going and what the posted speed limit was in that zone.
BOTTOM LINE: Your best bet is to pay the ticket or go to court, admit responsibility, and request leniency. If you go before the judge and own up to your error, there’s a chance the judge will cut you a break. But if you go in there with an axe to grind or if you try to weasel your way out of the ticket, the judge will hit you with the full amount of the fine plus court costs.
