California 22350/vc22349 vc?

my question is for somone to be charged with a California vc 22 349 (violation of speed limit) the state (witnesses and police) must first prove that vc22350 (the basic speed law ") was violated. So if the state I can not prove they were in violation the basic speed law charged with the correct song vc22349??

Not sure I'm following the logic here. VC 22350 is the basic law speed … what is reasonable and prudent for existing conditions. That is usually the speed limit, but could be different in different circumstances. 22,349 CV says it is illegal to drive faster than 65 (70 under certain conditions). Period. No matter who you are, how well you drive, or what kind of car you drive. The two are apples and oranges.
