What is the best way to contest a CA speeding ticket?
I wasn’t speeding, Highway patrol pulls me over says I was going 81 in 65 zone. I wasn’t, I was the slowest car on the highway. This is unjust and unfair and I want to contest this in the best way possible. Any advice is welcome.
Saying that you don’t believe me isn’t help – it is true that I was not speeding and I do have the time to contest it. People who do not contest what is unjust is why CHP think they can get away with giving tickets to anybody just so they can meet their quota.
It does not matter how fast anybody else was going. What matters is how fast you were going. It does not matter whether you were going 81 mph. What matters is whether you were exceeding 65 mph (the maximum speed limit). To be found not guilty, the hearing officer will have to conclude that there is no proof that you were exceeding 65 mph.
It is going to be very hard to convince any hearing officer that the patrolman made an error of 16 mph in your speed. You would need some pretty good evidence of such an error in order to prevail. You don’t indicate that you have any such evidence, beyond your say so.
However, if you appear in court and act reasonable (rather than arguing that the CHP is knowingly giving tickets to the innocent), there is a good argument that the patrolman could have made a 1 mph error. That will reduce the scheduled fine from $321 to $201. You could then ask for traffic school, which will cost a bit more, but keep it off your record.
