Be a defense against the old photo of a CC ticket stay valid?
In Washington DC, a photo ticket was dismissed last year. Basically, precision radar was questioned because there was another car in the photo. The exact words were: "As the government to present photo shows several vehicles traveling through the area of radar in a reverse direction, the government has failed to prove by clear and convincing evidence that defendant vehicles was identified as the speeding vehicle. Thus, the ticket is dismissed. "If someone gets a ticket in the same photo machine, and no other vehicle in the frame, will this defense work? Or the judges have discretion over the sentence?
It would indeed be a valid defense.
