What is the penalty of being caught driving with a passenger before the first 12 months of driving?

If a 16 year old was arrested in California by something like a slower ticket and was surprised with another 16 in the car, what would happen to the driver and passenger?

The penalty from where I live is the suspension of driver's license. Nothing happens when a passenger (being a passenger is not against the law.) I think the length of suspension depends on the severity of the crime. In my state you get a warning for a moving violation suspension after the start of each subsequent violation. I do not know about California … but I guess it's similar.
