im 19 and never been in trouble exept a speeding ticket …. I and some friends were to Florida and decided to do stupid things. I have chargd burgurly theft and this is my first offense and I've been through arraighnment. i in the cutoff date for the first time a conviction …. Does this mean that you get treatment Thery offer me? What are some things you can do?
Hi Ryan. Being a first time offender usually means less than the maximum time allowed for the wide dissemination of the charge (s) found. In non-violent crimes, an agreement with the prosecutor is not too unusual. A plea bargain is a method used by the judicial system to help reduce the number of cases and ultimately help keep public expenditure down. A plea bargain (if accepted) is an admission of guilt on their part to not allowed to present appeals cases on a date later, so it has to be taken seriously. If you take the plea, you agree to accept the blame and less time service (or perhaps a criminal probation first). If you refuse the request and take in the view (calling to "take the box"), you will receive the maximum penalty allowed by law, if you lose the case. This is the penalty imposed by the court, and offered him a reduced sentence but he thought he could win the case and did not. As stated above me, If you're offered a plea bargain to reduce the charge to a misdemeanor, you should accept. A felony charge can ruin your life. If the reason is that it has left as a felony, then you have to consider the amount of time available compared with what could be convicted if they go to trial and lose. When you appear the court, dressed as if you go to church. Wear a suit, his shoes are shined, hair cut short and is clean and neat. No second chance to make a first printing. Although the District Attorney's office could have offered a reduced sentence in a plea, is completely up to the judge. If he feels for his appearance and attitude that is disrespectful of him and the law can and will completely ignore the conviction and sentence more harshly. Good luck and I hope this is of utility
