Charged with a Class E felony in NY… help?

Hi everyone.

I was arrested and charged for a Class E Felony in New York, specifically for the offense of “falsifying business records.”

What happened was I purchased speakers from Target yesterday, which costed $60. Today, I went into another Target store, picked up the same model of speakers off the shelf, and returned it with my receipt from the purchase before.

I was obviously caught.

Now, will I be convicted of a felony or will the judge be likely to bump it down to a misdemeanor? I have a clean record, no prior arrests and not even a speeding/parking ticket.

Anyone know what I should expect with my court appearance in two weeks?

Sounds to me like you were overcharged – $60 worth of merchandise is more like petit larceny – A misdemeanor.

You need to talk to your lawyer about whether that charge fits. Sounds like a bunch of neo-nazis charged you. Did you alter the receipt in anyway? First beg for mercy…

Many first time/no record store thieves get an acd -adjournment in contemplation of dismissal which means the charge is dismissed after six months.

I don’t know what District Attorney would pursue that charge as an E Felony – the lowest. Normally always reduced to the A misdemeanor since the penalty range of the two are about the same and the E felony is more work for the office.

A misdemeanor – up to 1 year jail (rare for first timer) or 3 years probation

E Felony – up to 1-3 prison (rare for first timer)
