lose the right of way if speeding in Ohio?

I was beaten to buy a guy who was speeding through a school zone. I received a citation for lack of performance since he was turning left when it hit me. Since it was speeding they can lose their right of way since it was speeding?

Well, you could be in a better position than you were able to demonstrate the fact that he was speeding. But for FFECTS really I do not know if speeding him to lose his right of way. One can argue that was speeding (if you can prove) and he gave, but misjudged the time because at high speed. I do not know, it is likely that they will lose their case, but might be able to take him to civil court and sue for damages to your vehicle and possibly court costs. Gotta love New York
