Can I appeal my guilty conviction for a speeding ticket in Ontario?
Hi,
On May 2nd, 2010 I got a speeding ticket in the City of Vaughan for speeding 49km/h over the limit and I also got a ticket for failing to change lanes. I plead guilty with an explanation hoping that the judge would reduce my fine/demerit points/charge after I explained to him that I had a perfect driiving record in the 13 years I’ve been driving and the 8 years I’ve been driving with my full G licence. I thought when I pleaded guilty with an explanation that I would get a court date but then I later realized that was not the case. I want to appeal my own guilty plea so I can plead not guilty and set up a court date where I would convince the judge to lower my charge/fine/demerit points. I was convicted on May 14th and have not paid the fines yet as I have been given 60 days to pay.
Is it too late to appeal?
By the way, I’m a 29 year old male driver.
I would think not, but a quick google suggests I am wrong.

Picture this – you decided to represent yourself in Traffic Court (Ontario Court of Justice – Provincial Offences Division). You thought you had a valid defence, but you were found guilty and convicted. Maybe there was an obvious mistake made; maybe you’re not aware of the mistake. Maybe you plead guilty without informed consent. Keep in mind that in traffic Court, Justices of the Peace (JP’s) make the rulings, and not real judges. JP’s don’t have the same legal training as a real judge; a judge has been a lawyer for many years – this is not true of a J.P. ”
