How often does PA state trooper radar gun need to be calibrated?
I was driving home with a friend following. The speed limit was 45 and we were traveling about 55/60. The road was pretty windy in areas and we had come up to another vehicle. I happened to look down at the GPS that I had hooked up and it indicated that I was going 54 mph. I looked back at my friend behind me and noticed that there was a state trooper behind him. I then looked the the speedometer and it verified that we were going 54 mph. I figured that we were fine.
Well, he ended up pulling over my friend. I went ahead into the nearest town, cause my friend had no idea where they were at. I happened to stop at the store and when I went to leave there, that SAME police officer pulled me over. He told me that I should have kept going. He wrote me a ticket for going 63 in a 45. When he actually pulled me over, I was only going 27.
Can I fight this ticket?
An officer is required to check calibration on a regular basis, and again after a ticket is issued. This is normally done at the beginning of every shift.
If there is a problem with radar, it is almost always an error on the part of the operator and not an issue with the unit itself.
Keep in mind it is not how fast you are going when you saw the officer, it was how fast you were going when he saw you. My guess is he had your speed locked in long before you even knew he was there.
