How to appeal a speed camera fine in the UK?
Hi, recently a family member was flashed by a camera – doing 36mph. I have been told that they were medically unwell and were trying to get home to get their medicine (asthma attack). Is there anyway this can be appealed?
I have also been told that if you are going to appeal you have the right to ask for the calibration certificate if the speed camera and for the original police evidence. Where do you do that? At the moment just a letter requesting the identity of the driver has been received. Does one wait till a court date is given before requesting these documents? Please advise. Thanks.
from what u are saying it appears that your relative (A) is admitting to speeding but had a valid reason for doing so.
If this is the case A should return thr Notice of Intended Prosecution stating they were the driver but requesting a court hearing. A should then get a date for the Hearing and when they appear advise the Magistrates and Legal Advisor that they are pleading Guilty but wish to raise ‘special reasons’ why their licence should not be endorsed with penalty points. The case will either b adjourned to another date for the special reasons argument to take place or might be done there and then if there is time. Basically A should outline to the Court as fully as poss their medical condition and why they were speeding (it is a good idea to bring documentary proof of the medical condition). The Prosecutor and the Mags might have some questions of A, then the Mags will decide whether or not to grant special reasons. If they do then A’s licence will not be endorsed with penalty points and maybe just a fine and costs.
