In a car accident, can you blame the driver successfully sue?
My 16yr old was involved in a car accident. She was in front a road and another car was making a left turn and turned in front of it causing my daughter to hit her car. The other driver issued a ticket for careless operation. A car behind my daughter was a witness to the accident with a passenger with my daughter. The guilty driver was a lady 78-year-old who was with her sister 80 years old on his way to a casino. They are fighting the ticket saying that my daughter was speeding and did not even use your brakes because there was no skid marks. This was at 8:30 pm and was dark. It is also stated that the older sister was wounded. But when I asked if they were good mention was made of the sister hit her head against the window on impact, but she was fine. He also stated that he had an aneurysm (sp?) 4 months earlier. The report police that my daughter was doing the speed limit and the driver behind her saw his brake lights. Can they win?
Yes, because a demand liability is not who is right or wrong, but that is more compelling.
