Is there are form to have your case thrown out of court if the court date is over 8 months after the offence?

In March ’07, my mom was driving, checked her mirrors, and changed lanes. She didn’t notice that a cop car from a few cars behind her also changed lanes real quick and came speeding up into the lane she just changed into. So she got pulled over for cutting off a cop car (unsafe lane change). Mom insists that she checked all her mirrors and saw no cars in the lane she wanted to change into. Court date is set for March 2008. This happened in Toronto, Ontario.

I heard that in Ontario, there’s a form you can fill out that automatically throws the case out since the court date is over 8 months after the incident. If this is true, where can I find this form? Any advice would be appreciated

The “Speedy Trial” concept is to keep people from languishing in jail for indeterminate periods of time.
