Can the police charge me for speeding without pulling on me?

Can the police charge if the capture device acceleration handheld (laser or radar gun) without pulling you back? Or do you have to keep your vehicle? That could have been a little more the limit speed in NSW Australia, when I passed a policeman with a hand-held device that will not pull on me.

The handheld device can make a record his speed and plate number, and it's up to the officer if a report about his speeding. In general, in most places, it would be nice to make a few miles per hour over the limit, but it is much safer to stay in or slightly below. You arrive at your destination almost as quickly, anyway.
